12.Communications via electronic means

This prohibition includes: a) sending messages to people who don’t know you or are unlikely to recognize you as a known contact; b) connecting to unknown contacts and sending unsolicited promotional messages to those direct connections without their permission; and c) sending messages to distribution lists, newsgroup aliases, or group aliases.

18.Terms remaining after agreement ends

Despite any other provisions of this ToU or basic legal principles, any provision that imposes or envisions continuing duties on a party will survive its expiration or termination.

19.GENERAL

The parties agree that the court should give effect to the partie’s intentions as reflected in the provision, and the unenforceable condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition. Headings are for reference only and do not limit section scope. This ToU and your relationship with Buildmyfinance will be governed by Indian law without respect to its conflict of law rules. You and Buildmyfinance agree to submit to Gurgaon courts’ personal jurisdiction for any legal proceedings related to this ToU. Buildmyfinance’s refusal to act on your or others’ breaches does not renounce its right to act on such violations. Buildmyfinance cannot guarantee it will enforce all ToU violations. No third parties are beneficiaries of this ToU except as clearly stated. This ToU supersedes any earlier agreements between you and Buildmyfinance regarding the Site and governs your use of it.
